Working Hours

Employees can work up to 8 hours a day, or a maximum of 45 hours per week.

Minimum Wage

CDF 7.075 per day.

Bonuses

There are no statutory bonus schemes in the Democratic Republic of Congo.

Employment contracts in the Democratic Republic of Congo must be written in French. They must include:

• Employee ID information including INSS number
• Employee’s family status and details
• Job title and responsibilities
• Place of work
• Salary and benefits
• Contract length and work start date
• Notice period
• Medical certificate proving ability to work

The employer must submit the contract to the Office National de l’Emploi for approval within 15 days of the signature date.

Annual Leave

Minimum of 1 day's leave per full month of service for employees aged 18+, or 1.5 days for employees younger than 18.

Sick Leave

Employees are entitled to two-thirds of their salary for the duration of their suspension.

Parental Leave

• Maternity leave: at least 14 weeks' leave, paid at two-thirds of the mother's salary.
• Paternity leave: 2 days' paid leave.

Termination Process

Employers and employees in DR Congo can terminate a contract provided they give at least 14 days' notice.

Terminating a contract without a valid reason entitles the worker to reinstatement or financial damages.

Invalid reasons include:

• Membership of a union
• Filing a complaint against the employer
• Socio-economic and medical factors
• Absence from work during maternity leave

Severance Pay

There is no statutory severance pay requirement in DR Congo.
