Working Hours

Employees can work 8 hours a day, up to 40 hours a week.

Employees in certain sectors can work longer hours, up to 12 hours a day.

Minimum Wage

BSD 260 per week.

Bonuses

Bonuses are common in the Bahamas, but there are no statutory bonus schemes.

There is no legal requirement for a contract of employment to be in writing. An employment contract can have expressed or implied terms.

All contracts should include:

• Names of both parties
• Employment duration (if fixed-term)
• Job title and responsibilities
• Salary
• Contracted working hours

Annual Leave

Minimum of ten days' paid annual holiday after one year of service, rising to 15 days after ten years of service.

Sick Leave

Employees who have been employed for 6 months or more are entitled to one week's paid sick leave.

This doesn't apply if just one day of sick leave is taken, and the employee doesn't have a medical certificate.

Parental Leave

• Maternity leave: mothers can take up to 12 week's leave, with at least one week taken before and at least eight weeks taken after the birth. A one-off maternity payment is 33.3% of their wage (or the proportion that doesn't exceed the National Insurance ceiling).
• Paternity leave: one week's unpaid leave.

Termination Process

Employers can dismiss an employee without pay or notice for misconduct or fundamental breach of contract. The employer must conduct a reasonable investigation of any misconduct.

Alternatively, an employer or employee can terminate a contract in line with the contract requirements.

Severance Pay

No severance pay is due if the employee's length of service is less than 180 days.

After this, employees are entitled to 1-4 weeks' severance pay per year of service, depending on their role.
