Termination Process
In St. Lucia, a contract may be terminated without notice if the employee is guilty of serious misconduct.
An indefinite contract may be terminated with the following notice periods given in writing:
- 12 weeks – 2 years: 1 weeks’ notice
- 2 – 5 years: 2 weeks’ notice
- 5 – 10 years: 4 weeks’ notice
- 10+ years: 6 weeks’ notice
If the employee is being made redundant and has been employed for more than two years, they are entitled to one week's pay for each year of service up to the first three years. This rises to two weeks’ pay for each year of service between three and seven years, then three weeks’ pay for each year of service above seven years.
Severance Pay
In St. Lucia, severance pay is calculated based on length of service:
- 1-3 years: one week’s pay
- 3-7 years: two weeks’ pay
- 7+ years: three weeks’ pay
