Working Hours

Employees should not work more than 56 hours per week. The standard working week is 40 hours.

Minimum Wage

Bonuses

Bonuses are common in the Benin, but there are no statutory bonus schemes.

Employment contracts can be written or oral, but contracts written in French are best.

All contracts should include:

• Termination requirements

Fixed-term contracts are permitted up to 48 months.

Annual Leave

Minimum of 24 days' paid holiday per year, rising to 26 days after 20 years of service.

Sick Leave

Sick leave entitlement depends on length of service. Generally, employees are entitled to three months’ sick leave at full pay and 3 months at half pay, rising to 6 months’ fully paid sick leave after 5 years of service.

Parental Leave

• Maternity leave: 14 weeks' paid leave.
• Paternity leave: 3 days' paid leave.

Termination Process

Employers need fair grounds for dismissal. These include:

• Business liquidation
• Redundancy
• Organisational changes
• Employee competence or conduct
• Employee health

Employers should give 15 days' to 3 months' notice of dismissal, depending on the worker's position.

Severance Pay

Employees are entitled to 30-40% of their average monthly salary in severance pay, depending on their length of service.
