Working Hours

In Romania, employees cannot exceed 40 hours over five days per week. Up to 48 hours can be worked but will be considered overtime.

Minimum Wage

In Romania, the minimum gross base salary for a full-time employee is set by government decree each year. From 1 July 2024, the minimum gross salary increased from RON 3,300 to RON 3,700 per month.

Effective 1 January 2025, the minimum wage is set at RON 4,050 per month.

Bonuses

There are no statutory bonus schemes in Romania.

Romanian employment contracts must be written and in Romanian. The standard form of employment agreement is set out by government order and contains the minimum provisions which must be included in the contract, including:

• Place of work.
• Position.
• Typical risks of the job.
• Holiday entitlement.
• Base salary and other salary rights.
• Normal working time.
• Criteria for the assessment of professional performance.

As a rule, the individual employment contract is an unlimited term contract.  However, employment contracts may also be fixed term or part-time.

Annual Leave

Employees in Romania are entitled to 20 days of annual leave.

Sick Leave

Employees in Romania are entitled to paid medical leave where they have an illness or injury.

Paid medical leave is conditional upon the employee having worked for at least one month during the preceding 12 months (except in the cases of urgent surgery, tuberculosis, certain contagious diseases, or AIDS).

The maximum duration of paid time off is 183 days per year, which can be increased up to 18 months in total for certain illnesses.

Parental Leave

Romania offers 126 days of maternity leave, of which 63 must be taken before the birth and 63 after the birth.

Paternity leave may be taken up to five days.

Termination Process

Employers in Romania must adhere to the following notice periods when terminating a contract:

• 13 weeks to two years: One week
• Two to five years: Two weeks
• Five to ten years: Four weeks
• Ten to fifteen years: Six weeks
• More than fifteen years: Eight weeks.

Severance Pay

Romanian employment law makes no provision for severance payments for employees working in the private sector (except for the minimum notice period that applies). Severance payments are generally provided for in applicable collective labour agreements.
