Working Hours

Standard working hours are 8 hours a day, 48 hours a week. Hours over the working hours are considered overtime and paid at a 50% surcharge. Overtime cannot exceed 80 hours a quarter.

Standard nighttime work is between 06.00 pm and 06.00 am, and is paid at double the daily rate.

Minimum Wage

The applicable minimum wage depends on the specific sector, and currently this ranges from HTG 350 to HTG 770 per day.

Bonuses

In Haiti, an additional, compulsory salary is paid between the 24th and 31st of December.

Foreign employers are more likely to provide discretionary benefits such as private medical insurance, life insurance, and better yearly leave days. Non-statutory benefits are rare.

Employment contracts in Haiti must be written in French or Creole.

There are three types of employment contracts in Grenada:

A fixed-term/temporary contract

An indefinite contract

An apprenticeship contract

The duration of a fixed-term contract should neither be less than one (1) year nor more than five (5) years. If the term is not specified, it is presumed to be concluded for one (1) year.

Annual Leave

Leave entitlement is 15 days for 12 months of service or 1.25 days per month. Employees with less than 12 months of service are entitled to 1.25 days per month worked. Annual leave can be accumulated, if agreed in writing for up to two years.

Sick Leave

Employees with 12 months of service are entitled to 15 days of sick leave, with the presentation of a medical certificate from a company doctor or the Public Health Service. Sick leave for employees with less than 12 months is proportioned accordingly. Sick leave is paid by the employer.

Parental Leave

• Maternity leave: 12 weeks, with 6 weeks scheduled before delivery, and 6 weeks after delivery.
• Paternity leave: none

Termination Process

Notice is determined by the length of service and starting with employees who have worked for three consecutive months.

There are three ways to terminate a contract:

In specific cases such as redundancy, mutual consent, expiry of the contract, sufficient cause for termination, or death of the employee or employer.

The mutual consent of both parties.

Termination by the employer or employee.

Severance Pay

The employer must pay severance compensation, typically as follows:

• 50% of one (1) month’s salary for employees with 3 to 12 months of service, and
• One (1) month’s salary for each year of service for employees with more than one (1) year of service.
