Parental Leave

St. Maarten offers 16 weeks of maternity leave and seven days of paternity leave.

Termination Process

St. Maarten has mandatory rules and regulations regarding termination of employment agreements.

Dismissal without notice is allowed if there is an urgent reason. Usually, in order to terminate a contract, written notice must be given.

Notice periods relate to the length of service:

• 1-5 years: one month
• 5-10 years: two months
• 10-15 years: three months
• 15+ years: four months

Severance Pay

In St. Maarten, severance pay is calculated by length of service:

• 1 -10 years: one week’s wages per year.
• 11 – 20 years: 1.25 week’s wages per year.
• 20+ years: two weeks’ wages per year.
