UK Remote Right to Work Checks Extended to April 2022
The Home Office Announces the Extension of its Temporary Right to Work Check Concessions
The UK government has announced an extension to the digital right to work checks.
The temporary adjustments, which allowed employers to carry out their right to work checks remotely, were set to end on 31st August 2021 but due to a vast amount of positive feedback, the deadline has been extended to 5th April 2022.
From 6th April 2022, employers must comply with pre-pandemic rules by checking individuals’ original documents, rather than scanning or photographing the document. Alternatively, they can use the Home Office’s Right to Work check tool. While the documents are in the hand of the employer, checks must be completed in the physical presence of the individual or via a live video link.
The online right to work service is available to individuals who hold a biometric residence permit or residence card, or those who have been granted UK immigration status under the EU settlement scheme or points-based immigration system. The use of online checks is only allowed with the permission of the employee, and employers are not permitted to discriminate against applicants who refuse to allow access to their records.
Despite plans to return to pre-pandemic Right to Work checks, the Home Office has stated they have intentions to introduce a new digital solution to include those who are unable to access the Home Office online checking service. This will enable remote completion of checks but with enhanced security. The extension provides support to employers whilst the government looks to implement a long-term, post-pandemic solution.
